Warranty Information: xTablets
Warranty
MobileDemand provides a limited warranty that its products will be free from defects in material and/or workmanship which occur during normal use and perform substantially in accordance with MobileDemand specifications for the specified warranty period. MobileDemand computers (tablets and handhelds) are guaranteed against defects in materials and workmanship. Periods vary by product. Please see specific product page for product specific warranty information Batteries are covered for a period of six (6) months. Cables, chargers, mounts and other accessory items are specifically warranted for a period of ninety (90) days from product purchase. xProtect warranty programs will extend the warranty period of the computers, but not batteries and other accessories.
MobileDemand will repair the equipment during the warranty period with new or rebuilt parts, free of charge in the United States. All foreign orders will be subject up to a $75.00 USD charge. MobileDemand reserves the right in its sole judgment to determine if the failure or defect is a warrantable failure or defect. A purchase receipt or other proof of date of original purchase may be required before warranty performance is rendered. Products and/or services MobileDemand acquires from or through a manufacturer, distributor, or other third-party provider and resells and/or provides to customer will carry the original manufacturer's pass-through warranty of parts only, if any.
Authorization
All products covered by this warranty will be serviced at MobileDemand’s designated service center.
In order to obtain service under this limited warranty, customer must notify MobileDemand of the claimed defect before the expiration of the limited warranty period and obtain from MobileDemand a return authorization number for return of the product to the designated MobileDemand service center. Unless otherwise instructed by MobileDemand, all products returned under warranty are to be shipped to the following address. The MobileDemand supplied RMA form must be included in the shipping container.

The RMA number must be legibly written on the outside of the shipping container. Returns without an RMA number may be rejected. Product must be re-packaged in its original factory shipping packaging when returned for warranty service. If the original packaging is not available, customer must purchase packaging material from MobileDemand.
Warranty is considered void if products are not returned in original or MobileDemand authorized packaging. Contact MobileDemand with any questions.
Do not use foam peanuts in packaging. This material is not anti-static and may damage the electronic components, thereby voiding the warranty.
Product shall be returned to MobileDemand in clean condition. If product returned is extensively dirty, MobileDemand may choose, in its sole determination, to refuse the product for repair and send product back to customer, or clean the product and charge the customer a $25 cleaning fee, regardless of applicable warranty state.
MobileDemand assumes no liability for damage or loss in transit.
Shipping
Customer shall be responsible for packaging and shipping the product to the designated MobileDemand service center, with shipping charges prepaid by the customer. MobileDemand shall pay for the return of the product, via ground (2-5 days) to the customer’s location. Expedited shipping is also available at the customer’s expense. The customer shall be responsible for paying all shipping charges, duties, taxes, and any other charges for products returned to any other locations.
Warranty is subject to the limitations and exclusions set forth in the paragraphs that follow.
Damage and Other Repairs
Product returned for warranty service where the problem cannot be duplicated and no detected hardware failure is subject to a service charge plus shipping costs. Service performed outside the scope of this warranty will be charged at current time and material rates plus shipping costs.
Disclaimer
WARRANTY SET FORTH ABOVE IS IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS.
Exclusions
Warranty coverage shall not apply to any claimed defect, failure, or damage which MobileDemand determines was caused by: abuse, neglect, improper use of product; failure to provide product maintenance, including but not limited to cleaning of the display in accordance with the product reference guide; installation or service of the product by other than MobileDemand representatives; use of the product with any other instrument, equipment, or apparatus; modification or alteration of the product or units with Warranty Void labels that have been tampered with. External cables and replacement of the upper window/cartridge due to scratching, stains, or other degradation will not be covered under the warranty. External power supplies returned for service must be accompanied by the original product for the performance of service.
Returned products that MobileDemand has determined are not covered by warranty will be charged MobileDemand's standard repair rates in effect for the repair of the product. Replacement of the display due to scratching, stains, or other degradation will not be covered under warranty. If a product is determined to be unrepairable, the customer will be notified and the product can be returned to the customer at their request. A minimum service fee may be charged.
This warranty specifically excludes damage to the product including, but not limited to the following:
- Damage during shipment other than the original shipment to the customer;
- Damage caused by liquid intrusion inside the product as a result of case fracture or entry through an external port or door;
- Damage caused by impact with other objects or drops and falls, including but not limited to broken display glass, touch panel glass, hard drive sector damage or read/write head damage, physical breakaway of internal components;
- Damage caused by faulty electrical/wiring connections and installations of the tablet to vehicles or other electrical or power sources, or disregard for the methods and instructions in the wiring installation guides;
- Damage caused by over-use and abuse of connectors on the product whereby alternative methods are available through docking or adapters to protect product connectors;
- Damage caused by the use of the product for purposes other than those for which it was designed;
- Damage caused by any other abuse, misuse, neglect, accident, negligence, mishandling or misapplication;
- Damage caused by products not supplied by MobileDemand or failures which result from alterations, modifications, or foreign objects;
- Damage from improper maintenance; or
- Damage attributable to acts of God.
In no event shall MobileDemand be liable, whether in contract, negligence, tort, or on any other basis, for cover or for incidental, consequential, punitive, or exemplary damages arising out of or in connection with the sale, services, maintenance, use, performance, failure, or interruption in the operation of the hardware, software, or services, even if MobileDemand is advised of the possibility of such damages.
Customer Data and Information
MobileDemand is not responsible for any software programs, data, or other information stored or used on any media or part of any product returned to MobileDemand for warranty service or other repair, including the costs of recovering such programs or data. If during the warranty service or repair of the product, the contents of the hard disk or any other data storage media are altered, deleted, modified, or lost, MobileDemand is not responsible and shall have no liability for the loss of data or damage or deletion to any non-factory installed software or hardware. It is customer's sole responsibility to back up any software programs, data, or information stored on any storage media or any part of the product returned for warranty service or out-of-warranty repair.
Limitation of Liability
MobileDemand’s repair or replacement of defective product as set forth above is the customer’s sole and exclusive remedy on account of claims of breach of warranty or product defect. Under no circumstances will MobileDemand be liable to customer or any third party for any lost profits, or any incidental, consequential in-direct, special or contingent damages regardless of whether MobileDemand had advance notice of the possibility of such damages.
MobileDemand’s entire liability and Customer’s sole and exclusive remedy for any product that fails to comply with this warranty shall be, at MobileDemand’s option and expense: (i) to repair the non-conforming product; or (ii) to provide an equivalent replacement. Customer is responsible for returning the non-conforming product, properly packaged, to the MobileDemand service center. Replacement parts or units shall not extend the original warranty and shall have a ninety (90) day limited warranty for defects in materials and workmanship.
The warranty period is not extended as a result of upgrading the product. To receive warranty service, the customer must promptly notify MobileDemand of the warranty claim prior to expiration of the applicable warranty period.
MobileDemand has the right to suspend warranty support for any customer with unpaid past due invoices.
Assignment
This warranty is not transferable and applies only to the original end-user and the original product.
Risk of Loss
Customer shall bear risk of loss or damage for product in transit to MobileDemand. MobileDemand shall assume risk of loss or damage for product in MobileDemand’s possession or product being returned to customer by MobileDemand, except such loss or damage as may be caused by the negligence of customer, its agents or employees. In the absence of specific written instructions for the return of product to customer, MobileDemand will select the carrier, but MobileDemand shall not thereby assume any liability in connection with the return shipment.
xProtect Comprehensive Service Plan (Optional)
The price paid for the extended warranties and xProtect service plan includes an initiation fee of $75 for data entry and system setup services for the warranties purchased.

Warranty
MobileDemand warrants the xCase/rugged case (the "Product") to be free of all defects in material and workmanship for one year from original date of purchase from MobileDemand (the "Warranty"). This Warranty extends only to the original buyer, not to any successive buyers.
During this Warranty period, MobileDemand will repair or replace, free of charge, using like quality parts at its discretion, any Product part proving to be defective in material or workmanship. This Warranty does not cover normal wear and tear or defects caused by abuse, mishandling beyond its intended purpose, damage resulting from the customer's failure to observe all installation instructions furnished at the time of installation negligence by the Customer, or by any acts of nature.
All expenses related to replacing or repairing a defective part under this Warranty shall be assumed by MobileDemand, except that the original buyer shall be solely liable for all related shipping costs to MobileDemand. MobileDemand will cover return shipping costs back to the buyer. The original buyer shall accept all risk of loss, damage, or misplacement of any Product in shipment.
All Warranty service must be performed by an authorized MobileDemand technician. Any service performed on the Product by a non-authorized MobileDemand technician will void this Warranty in its entirety.
If the Product under this Warranty needs replacing or repairing, a service RMA is required. Please visit the MobileDemand website to submit the RMA.
Limited Liability
As to any claim of whatever nature asserted against MobileDemand that relates to the product(s) you purchased from MobileDemand, your exclusive and sole remedy is expressly limited to the following:
In no event shall MobileDemand, its officers, directors, shareholders or employees (collectively, "MobileDemand"), its partners or its suppliers shall be liable to you or any third party for any indirect, incidental, consequential, punitive, special or consequential damages arising out of the use of the product, including, without limitation, property damage, loss of value of the product or any third party products that are used in or with the product, or loss of use of the product or any third party products that are used in or with the product, or any loss of business, loss of profits or goodwill. MobileDemand has no liability for any damage or destruction to consumer electronics devices or other personal property that are in the products, including, without limitation, tablets, stylus, keyboards, laptops, cell phones, or handheld devices, or any loss of data, software or apps contained in the devices. Notwithstanding any damages that might incur for any reason whatsoever (including, without limitation, all damages referenced herein and all direct or general damages in contract, infringement, strict liability, tort (including negligence) or otherwise), the maximum limit of liability of MobileDemand, its partners and any of its suppliers shall be the amount actually paid by you for the specific product in dispute. Some states and/or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
No action, regardless of form, arising under this agreement, may be brought more than one year after the alleged cause of action has arisen.
Any repairs needed to the tablet itself must be done through the manufacturer. MobileDemand does not provide repair services for Surface®, Lenovo®, Samsung® or iPad® tablets.
